General Terms and Conditions
Applicable to all clients, passengers and users of the services of D&D Services BV.
1. Applicability
These general terms and conditions apply to all agreements concerning passenger transport concluded between the client and D&D Services BV, with registered office at Senator Alfons Jeurissenlaan 1154, 3520 Zonhoven, Belgium, registered with the CBE under number 0899.515.939.
2. Reservations
Reservations are made exclusively by e-mail or via the booking form at www.d-dservices.be. Clients with a fixed business agreement also have access to the booking portal via mobiliteitsnet.nl. Telephone reservations are only valid after explicit confirmation by D&D Services and are made entirely at the client's own risk. D&D Services cannot be held liable for errors or misunderstandings arising therefrom.
3. Required information
When making a reservation, the client must provide correct and complete information, including: – name and contact details – pick-up and drop-off address – number of passengers – date and time of transport – for airport or train station transfers: the exact flight or train number
In the event of incorrect or incomplete information, D&D Services cannot be held responsible for failure to carry out the transfer or for late execution.
4. Toll, parking and waiting time charges
– Toll costs are not included unless explicitly stated in the booking confirmation. – Parking costs are included in the standard rate. – A fixed surcharge of €10 applies to every pick-up at an airport or train station, including 1 hour of waiting time and 1 hour of parking. – After this hour, a waiting fee of €15 per commenced 15 minutes will be charged.
5. Payment
Unless explicitly agreed otherwise, transfers are to be paid upon arrival to the driver, in cash or by card. The booking form allows the client to indicate whether they are a business client. If an invoice is requested after the transfer without having indicated this in advance, an administrative fee of €15 will be charged.
6. Invoicing and late payment
Invoices are payable within 14 calendar days of the invoice date. In the event of non-payment, the following reminder fees apply: – 1st reminder: free of charge – 2nd reminder: €10 – 3rd notice: +€25 – 4th notice: +€50 and a registered letter, the costs of which will also be charged
For business clients (B2B), failure to pay by the due date automatically and without prior notice results in a contractual penalty of 12% on the outstanding amount, with a minimum of €25, as well as default interest of 12% per annum. For consumers (B2C), the applicable statutory consumer protection provisions apply.
7. Suspension in the event of non-payment
In the event of persistent non-payment, D&D Services reserves the right to suspend services with immediate effect until all outstanding invoices have been paid in full, without waiving any other rights.
8. Complaints
Complaints or objections must be submitted in writing within 8 calendar days of receipt of the invoice, either by registered letter or by e-mail with acknowledgement of receipt to info@d-dservices.be. Late complaints will be deemed inadmissible.
9. Bookings on behalf of third parties
When a reservation is made by a company or travel agency on behalf of a third party, the original client remains jointly and severally liable for full payment should the third party fail to pay.
10. Liability
D&D Services makes every effort to transport all clients to their destination on time. Under no circumstances does D&D Services accept liability for failure to arrive on time or for any resulting damages. Liability is in all cases limited to the amount of the transfer price, except in cases of intent or gross negligence on the part of D&D Services. Indirect or consequential damages are excluded from compensation.
11. Force majeure
D&D Services is not liable for delays or damages caused by force majeure, including traffic congestion, strikes, weather conditions, accidents, road diversions, technical failures or other unforeseen circumstances.
12. Pricing changes
D&D Services reserves the right to adjust its rates unilaterally and without prior notice. Such adjustments do not apply to bookings already confirmed and accepted by D&D Services.
13. Derogations
Derogations from these terms and conditions are only valid if confirmed in writing by registered letter by D&D Services.
14. Online price indication
D&D Services makes an online calculator available to its clients. The rates shown are non-binding price indications. Only the price stated on the final booking confirmation is binding and legally valid. Differences between the calculator and the final price cannot give rise to complaints or claims.
15. Client responsibilities
The client is responsible for complying with all legal obligations, including wearing a seatbelt and the correct use of child seats. Damage to the vehicle caused by the client or fellow passengers will be charged in full.
16. Misconduct and safety
D&D Services reserves the right to refuse or terminate transport in the event of aggression, excessive alcohol consumption, drug use or other unsafe behaviour. The full cost of the transfer will be charged in such cases.
17. Damage and cleaning
– Damage to the vehicle will be charged to the client. If the client cannot be held personally liable, the company that placed the reservation will be held responsible. – If the interior of the vehicle is soiled (e.g. vomit, mud, drinks), a cleaning fee of at least €75 will be charged.
18. Data protection
D&D Services processes personal data exclusively in the context of its services and in accordance with GDPR legislation. Data is not shared with third parties unless required by law or functionally necessary.
19. Transfer of rights
The client may not transfer their rights and obligations under this agreement without the prior written consent of D&D Services.
20. Severability
If any provision of these terms and conditions is declared invalid, the remaining provisions shall remain in full force. In that case, the parties undertake to replace the invalid provision with a valid clause that most closely reflects the original intent.
21. Fixed business clients
Separate agreements or service level agreements (SLAs) may be drawn up for regular clients or business partnerships. In the event of any conflict, these documents take precedence over the general terms and conditions.
22. Child seats
D&D Services provides child seats upon request, provided this is indicated at the time of booking. The client is responsible for correct use in accordance with applicable legislation. If the client wishes to use their own child seat, this must be communicated in advance. D&D Services cannot be held liable for improper installation carried out by or at the request of the client.
23. Luggage
Each passenger is entitled as standard to one suitcase and one piece of hand luggage. For larger groups or oversized luggage, D&D Services reserves the right to deploy a second vehicle, the cost of which will be charged to the client. Any special luggage requirements must be stated at the time of booking.
24. Animals
Animals may only be transported with the explicit prior consent of D&D Services. Animals must be transported in a closed carrier or cage. D&D Services reserves the right to refuse transport if this condition is not met. Any cleaning or damage costs caused by the animal will be charged in full to the client.
25. No smoking policy
Smoking, including the use of e-cigarettes and vaping devices, is strictly prohibited in all vehicles of D&D Services. In the event of a violation, a fixed cleaning fee of €150 will be charged, without prejudice to D&D Services' right to claim further damages.
26. Force majeure: consequences for payment
If D&D Services is unable to carry out the transfer due to force majeure (as described in art. 11) prior to departure, the client will be notified as soon as possible and an alternative solution or full refund will be offered. If force majeure occurs during the transfer, the client is liable for the portion already completed, calculated pro rata of the total transfer price.
27. Minors
Passengers under the age of 16 will only be transported if accompanied by an adult, or with the explicit written consent of a parent or legal guardian. D&D Services reserves the right to refuse transport if this condition is not met.
28. Governing law and jurisdiction
All agreements are governed by Belgian law. Only the courts of the judicial district of Hasselt have jurisdiction to hear any disputes.
Booking Conditions
1. General provisions
The stated rates apply on condition that: – The booking is made at least 24 hours in advance – One pick-up and one drop-off address are used
Deviations are possible but may incur additional charges.
2. Additional addresses
– +€10 per additional address if on the route (max. 4 addresses per transfer) – Off-route or more than 10 km detour: price on request – D&D Services always selects the most efficient route
3. Cancellations and no-shows
– Cancellation less than 6 hours in advance: €40 – Cancellation more than 6 hours in advance on the day of the transfer: €20 – If the driver is already en route or on site: costs at the discretion of D&D Services – No-show or incorrect booking resulting in an unnecessary trip: full cost will be charged
4. Changes, waiting times and last-minute bookings
– First 15 minutes of waiting time at pick-up for airport or train station transfers: free of charge – After that: €15 per commenced 15 minutes – Bookings made less than 6 hours in advance: +€40 express handling fee – Change of pick-up time by more than 1 hour, less than 6 hours before departure: +€30 – Bookings made after Friday 16:30 for transfers on weekends or Monday: additional surcharge at the discretion of D&D Services
5. Arrival delays
If the passenger has not yet arrived in the arrivals hall more than 1 hour after landing, €15 per commenced 15 minutes will be charged from minute 61 onwards.
6. Non-online bookings
Bookings made outside www.d-dservices.be/boek-nu or mobiliteitsnet.nl will be charged with a surcharge of €15 per transfer.
7. Premium vehicles
A surcharge of +50% on the standard rate applies to the Audi A8, Mercedes V-Class and BMW 7 Series.
